Terms of
Service.
Effective from: 8 October 2026
1. General provisions and provider details
These Terms of Service govern the use of the Crowdshow service available at crowdshow.io and the conclusion and performance of contracts for services provided electronically, including contracts for the supply of digital content and digital services (paid plans).
The provider and seller is Bartosz Kołodziej, a sole proprietor (Polish: jednoosobowa działalność gospodarcza) trading as Crowdshow, address: Łubowo 127, 62-260 Łubowo, Poland, Polish tax ID (NIP): 784-243-86-40, registered in the Polish Central Register and Information on Economic Activity (CEIDG). Contact: contact@crowdshow.io.
These Terms are available free of charge on the website in a form that can be downloaded, stored and printed. How we handle personal data is described in our Privacy Policy.
2. Definitions
- Service — the Crowdshow platform for running live quizzes and games, available at crowdshow.io.
- Provider, we — the person named in section 1.
- User, you — anyone using the Service, including Hosts and Players.
- Host — a User with an Account who creates games and questions, runs game sessions and invites Players.
- Player — a person who joins a game session with a game code or QR code, without an Account.
- Account — the Host's personal dashboard in the Service.
- Consumer — a natural person entering into a contract for purposes outside their trade, business or profession.
- Sole trader with consumer protection — under Polish law (art. 38a of the Consumer Rights Act), a natural person running a business who concludes a contract directly related to that business, where the contract is not of a professional nature for them (in particular given the business activity entered in the CEIDG register). Such persons enjoy the consumer protections described in sections 10, 11 and 14.
- Free plan, Party Pass, Full Access — the plans described in sections 5 and 6 and on the Pricing page.
- Digital content / digital service — data produced and supplied in digital form (e.g. question packs) and the service that lets you create and run games in the Service.
3. Technical requirements
To use the Service you need a device with internet access and an up-to-date web browser (e.g. Chrome, Safari, Firefox, Edge) with JavaScript and the cookies strictly necessary for signing in enabled. Hosts also need an active e-mail address. Players only need a phone or other device with a browser.
You must not supply unlawful content to the Service.
4. Host account
Creating an Account is free. You can sign up with an e-mail address (one-time link or password) or with your Google account. When the Account is created, an open-ended contract for maintaining the Account is concluded.
You must be an adult with full legal capacity to create an Account. You are responsible for keeping your access credentials confidential and must notify us promptly if you suspect unauthorized access.
Players do not create Accounts. When joining a game, a Player enters a nickname and a team name, which are shown on the game screen and in rankings.
5. Free plan
The Free plan is free of charge and not limited in time. It includes in particular: up to 3 games, up to 16 Players per game session and selected ready-made question packs. The current scope of the Free plan is shown on the Pricing page. We may change the scope of the Free plan with at least 14 days' notice.
6. Paid plans and prices
- Party Pass — a one-off payment of 19.99 USD. It unlocks all features and question packs for 72 hours from the moment the payment is confirmed. After that, the Account automatically returns to the Free plan. Party Pass does not renew.
- Full Access — an auto-renewing subscription: 29.99 USD per month or 249.99 USD per year. It unlocks all features and question packs for the whole paid billing period.
All prices are gross prices in US dollars (USD) and include VAT where applicable. Any tax due is calculated at checkout based on your country and shown in the order summary. The price displayed before you confirm the payment is the final price; any currency conversion fees charged by your bank or card issuer are outside our control.
7. Conclusion of contract and payment
To buy a paid plan, the Host selects a plan in the dashboard, is redirected to a secure checkout form and confirms the order with a button clearly indicating an obligation to pay. The contract is concluded when the payment is confirmed. We send a confirmation of the contract, including the legally required information, to the Host's e-mail address (durable medium).
Payments are processed by Stripe (Stripe Payments Europe, Ltd., Ireland). Available payment methods (e.g. payment cards, digital wallets) are shown at checkout. We do not store payment card details.
8. Full Access subscription — renewal and cancellation
The subscription renews automatically for a further period of the same length (one month or one year), and the fee is charged to the saved payment method at the start of each period until you cancel.
You can cancel at any time, without giving reasons, in your Account (Billing → "Manage subscription", the Stripe customer portal). Cancellation takes effect at the end of the current paid billing period — until then your access stays active and no further charges are made. Fees for the unused part of a started period are not refunded, unless the law provides otherwise (in particular after a valid withdrawal or complaint).
We will notify you by e-mail of any subscription price change at least 30 days before the start of the period to which the new price applies. A new price never applies to a period already paid. If you do not accept the change, you can cancel before it takes effect.
9. Invoices and payment confirmations
After each payment we automatically e-mail you a payment confirmation. We issue an invoice automatically if you entered invoice details at checkout (e.g. company name and VAT ID), or on request sent to contact@crowdshow.io. You agree to receive invoices electronically.
10. Right of withdrawal
If you are a Consumer (or a sole trader with consumer protection), you may withdraw from a distance contract within 14 days of its conclusion without giving any reason. To do so, send us a clear statement before the deadline, e.g. by e-mail to contact@crowdshow.io. You may use the following template, but it is not mandatory:
"I, [name], hereby give notice that I withdraw from my contract for the supply of [Party Pass / Full Access] concluded on [date]. Account e-mail: [address]. Date, signature (if sent on paper)."
Expiry of the right of withdrawal. Paid plans consist of digital content not supplied on a tangible medium and a digital service, made available immediately after payment. Before payment we ask for your express consent to begin performance before the end of the withdrawal period and for your acknowledgement that you thereby lose your right of withdrawal. If you give that consent and acknowledgement and we confirm it on a durable medium, your right of withdrawal expires when the supply of the digital content begins (art. 38(1)(13) of the Polish Consumer Rights Act of 30 May 2014; art. 16(m) of Directive 2011/83/EU; for consumers in Germany § 356(5) BGB), and for the service — when it has been fully performed.
If you validly withdraw, we will refund all payments received without undue delay and no later than 14 days after receiving your notice, using the same payment method, unless you agree otherwise; you will not incur any fees for the refund.
11. Complaints
We are liable to Consumers (and sole traders with consumer protection) for the conformity of digital content and digital services with the contract under the applicable statutory rules.
Please send complaints to contact@crowdshow.io. Including your Account e-mail, a description of the problem and the remedy you expect helps us handle it. We respond to complaints within 14 days of receipt, to the e-mail address the complaint came from. If we fail to respond to a Consumer's complaint within that time, the complaint is deemed accepted.
12. Content and data entered by Hosts
The Host is responsible for the content they add to the Service (questions, answers, images, game names, venue profile) and for its lawfulness, including respect for copyright and the personal rights of others. The Host grants us a non-exclusive, royalty-free licence to store, reproduce and display that content solely as needed to provide the Service.
The Host invites Players to game sessions and is responsible for the event they organise. If the Host enters other people's personal data into the Service (e.g. names in questions or team names), the Host is responsible for having a legal basis to do so. The Host makes sure that nicknames and team names shown on screen are appropriate for the audience and can remove them from a game.
AI-generated questions and ready-made question packs may contain inaccuracies. Hosts should check them before use.
13. Acceptable use
In particular, you must not:
- supply content that is unlawful, obscene, offensive, discriminatory, incites violence or infringes the rights of others;
- disrupt the Service, circumvent plan limits or attempt to access other Users' data without authorisation;
- scrape the Service or resell access to it without our consent;
- send spam or use the Service to collect Players' data for purposes other than running the game.
We may remove unlawful content or disable access to it once we receive credible notice of its unlawful nature. Illegal content can be reported to contact@crowdshow.io.
14. Liability
Towards Consumers (and sole traders with consumer protection) we are liable in accordance with the statutory rules; nothing in these Terms excludes or limits rights that they have under mandatory law.
We are not liable for content added by Hosts or Players, for the course or consequences of events organised by Hosts, or for interruptions caused by circumstances beyond our control (e.g. internet outages, failures of Users' devices, force majeure).
Towards Users who are not Consumers or sole traders with consumer protection, our liability is limited to actual loss and to the fees paid by that User in the 12 months preceding the event giving rise to liability, except for damage caused intentionally.
15. Availability
We aim to keep the Service running without interruption. Technical breaks (updates, maintenance) may occur; planned breaks are announced in advance where possible. The Service is under active development and features may change; such changes must not reduce the main characteristics of a plan a Consumer has paid for during the paid period, unless the law permits it. If the service does not conform to the contract, the rights described in section 11 apply.
16. Termination and account deletion
You may terminate the Account contract at any time by deleting your Account in the dashboard under My data (where you can also download an export of your data) or by writing to contact@crowdshow.io. Please cancel any active subscription before deleting your Account. Deleting the Account does not trigger a refund for a period already started, unless the law provides otherwise.
We may terminate the Account contract with 14 days' notice for important reasons (e.g. discontinuation of the Service) and with immediate effect in the event of a serious or persistent breach of these Terms despite a request to stop. If we terminate for reasons not attributable to you, we refund the pro-rata fee for the unused period.
17. Changes to these Terms
We may change these Terms for important reasons, such as changes in the law, changes to the scope or manner of providing the Service, a change of payment provider or security reasons. We will notify Hosts by e-mail and announce changes on the website at least 14 days before they take effect. Changes will not affect an already paid period of a paid plan to the Consumer's detriment. If you do not accept the changes, you may terminate the contract (delete your Account and cancel your subscription) before they take effect.
18. Governing law and disputes
Contracts under these Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence (art. 6 Rome I Regulation).
Disputes with Consumers are resolved by the courts having jurisdiction under the general rules, including the courts of the Consumer's place of residence where EU law so provides. Disputes with Users who are not Consumers are resolved by the court competent for the Provider's place of business.
Consumers may use out-of-court complaint and redress procedures, e.g. consumer advice bodies and alternative dispute resolution (ADR) entities in their country. The EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr) was discontinued on 20 July 2025 following the repeal of Regulation (EU) No 524/2013. We are not obliged to take part in ADR proceedings but will consider any such proposal.
19. Final provisions
These Terms take effect on 8 October 2026. Contracts concluded before that date are governed by the version in force at the time of their conclusion, subject to section 17. These Terms are also available in Polish and German; the version in the language in which the contract was concluded prevails.
